Terms & Conditions

The following Terms and Conditions are valid from 30 August 2007 and supersede previous Terms and Conditions.

Terms of Payment – 50% of the EcoSaw ‘List Price’ is required as a deposit to confirm your purchase order.  The remainder is required to be paid before shipment.  Parts that are available ex-stock require full payment with the order to enable immediate shipment.  EcoSaw will endeavour to contact the buyer 7 days before shipment is ready to enable swift payment. 

Purchases form our Online Shop must be made in FULL to complete the order processing.

Cancellations – Cancellations must be made within 7 days of the deposit being received by EcoSaw.  This is your legally required cooling off period.  After this period production of your order will start and cancellations can only de accepted at the discretion of the EcoSaw management. 

Returns – only parts incorrectly supplied by EcoSaw will be accepted for return with full refund of payment. 

Refunds – Full refunds are only available on parts incorrectly supplied by EcoSaw.

EcoSaw has a non-refundable policy on all products manufactured by us. ALL other refunds are at the discretion of the EcoSaw management.  In particular cancellations of orders for products after said products are in the production system are only part refundable after those said products have been sold and paid for in full by another customer. Administration and storage charges will apply to any refund the EcoSaw management has agreed to. 

 

Warranty – EcoSaw warrants all equipment of its own manufacture to be free of defects caused by faulty material or defective workmanship and EcoSaw will at their option exchange or repair free of charge, F.O.B. EcoSaw factory, such part of parts thereof that prove defective under normal use within 12 months from the date of shipment. 

 

This warranty does not apply to replacement or repairs which are required as a result of improper use, maladjustments or a lack of proper maintenance.  No claims for labour or other expenses will be recognized.  This warranty excludes all other warranties, express or implied. 

 

EcoSaw shall not be liable for any claims, losses, labour expenses or damages, direct or consequential, resulting directly or indirectly from the use of, or inability to use, its products. 

 

Shipment – F.O.B. EcoSaw factory,  Brierfield, NSW, Australia. 

 

Delivery Period – EcoSaw will endeavour to meet delivery schedules but in no case shall EcoSaw incur any liability, consequential or otherwise, for any delays or failure to deliver as a result of or for any cause beyond its reasonable control, including, without limiting the generality of the foregoing, fire, windstorm, riot, war, embargo, strikes, explosion, accident, flood, drought, earthquake, sabotage, disputes with workers, transportation conditions, inability to secure adequate material or labour, activities of the Armed Forces, acts of God or the public enemy,  Government actions of any kind.

 

Delivery quotations are our best estimate on the basis of current schedules. We reserve the right to allocate our inventories and current production.  In no event shall EcoSaw be liable for special or consequential damages resulting from failure to meet requested delivery schedules.
